Two documents in one place. The privacy policy covers what happens to information you give this site. The terms cover how work is booked, paid for, delivered and licensed.
This is a working draft, not legal advice, and I am not a lawyer. It is written to match how the business actually operates so that a Florida attorney has something concrete to review instead of a blank page. Before this goes live, fill in every bracketed placeholder, and have an attorney check the license terms, the liability limits and the governing law clause against your entity type and your insurance.
Short version: contact details you send are used to answer you and do the work, and nothing is sold to anybody.
This policy applies to Jacob Patrick Media, doing business as Jacob Patrick Media, and to the website at jacobpatrickmedia.com. It covers visitors to the site, people who send an inquiry, and clients who book work. Throughout this document, "I" and "me" mean the business, and "you" means whoever is reading it.
The business operates from Jacksonville, Florida and serves clients primarily in Northeast Florida and Southeast Georgia.
What you give me. When you fill in a form, send an email, book a shoot or sign a contract, that information is collected because you handed it over:
What is collected automatically. Like almost every website, this one records basic technical information when a page loads: the pages viewed, roughly where the visit came from, the type of device and browser, and the time. This is aggregate traffic information and is not used to build a profile of you.
What is never asked for on this site. Payment card numbers and bank details are never collected through this website. Invoices and payments run through a third party payment processor, and their systems, not mine, handle those numbers.
Information you send is not sold, rented or traded. It is not handed to advertising networks or data brokers.
This site aims to run without advertising or tracking cookies. Analytics are collected in aggregate to count visits and see which pages get read, not to follow individuals across other websites. If a cookie is needed for something functional, such as remembering that you dismissed a banner, it is used for that purpose only. One exception is worth naming: the contact page embeds an inquiry form from my booking platform, and that form is loaded from their servers and may set its own cookies in order to work and to connect your inquiry to your reply. If you would rather not load it, email me directly instead and nothing is embedded.
If any advertising or retargeting pixel is ever added to this site, this section will be updated to name it before it goes live, and a consent banner will appear where one is required.
Your browser can block or delete cookies through its own settings, and most of this site will work normally if you do.
Information is shared only with the services needed to run the business, and only the parts they need:
Each of these is bound by its own privacy terms. Beyond that, information is disclosed only when the law requires it, such as a valid subpoena or a tax authority request, or where it is needed to enforce an unpaid invoice.
This part is specific to a media business and is worth reading if you are hiring me.
You can ask me at any time to tell you what information about you I hold, correct anything wrong, delete what I am not required to keep, or stop sending you updates. Email jacob@jacobpatrickmedia.com and I will respond within 30 days. Records I have to keep for tax or contract reasons are the one exception, and I will say so if that applies.
Depending on where you live, you may have additional rights under your own state or country's privacy law. Those rights are honored on request whether or not the law technically applies to a business this size.
Accounts are protected with strong, unique passwords and two factor authentication where the service offers it. Files and client information live in reputable hosted services rather than on an unsecured machine, and backups are kept. No system is perfectly secure, and no honest business will tell you otherwise. If a breach ever affects your information, you will be told promptly and directly.
This site is aimed at businesses and property owners and is not directed at children. Information is not knowingly collected from anyone under 13. If you believe a child has sent information through this site, email me and it will be deleted.
If this policy changes, the updated version is posted here with a new date at the top. Material changes to how information is collected or shared will be described rather than quietly swapped in.
How work is booked, paid for and licensed. A signed project agreement, where one exists, sits on top of these terms.
These terms apply to all work performed by Jacob Patrick Media, doing business as Jacob Patrick Media. Booking a shoot, paying an invoice or accepting delivered files means you accept them. Where you have signed a separate project agreement or statement of work, that document controls anything it addresses, and these terms fill in everything it does not.
Services include real estate photography and video, aerial imagery, construction progress documentation, site mapping, video content production and marketing strategy work. Prices shown on this site are starting points for typical jobs, not a binding quote. A written quote covers a defined scope, and work outside that scope is quoted separately before it is done rather than added to an invoice afterward.
Quotes are valid for 30 days. Published rates can change, and rates marked as launch pricing are held for the period stated on the page.
Prices do not include any applicable sales tax, which is added where the law requires it.
Weather. Exterior and aerial work depends on conditions and on the legal ability to fly. A shoot moved for weather is rescheduled at no charge to the next workable window. This is Florida, so plan on it happening occasionally.
Your cancellations. Cancelling or rescheduling with more than 24 hours notice costs nothing. Inside 24 hours, or if the property is not ready or not accessible when I arrive, half the shoot fee is charged to cover the held date and the travel.
My cancellations. If I have to cancel for equipment failure, illness or anything else on my end, you get the next available slot at priority and any deposit back in full if you would rather not reschedule.
You are responsible for making sure I can legally be on the property and that whoever owns or controls it has agreed to the shoot. For interiors, the space should be photo ready when I arrive: lights working, surfaces clear, pets and vehicles moved, and blinds set. Light staging and small adjustments happen as a matter of course. Cleaning, decluttering and furniture moving are not part of the service.
If a property is not ready, the options are to shoot it as it stands, to use the remaining time on what is ready, or to reschedule under the cancellation terms above.
Copyright stays with me. Under United States copyright law, the photographer owns the images unless they are assigned in writing. Copyright in all photos, video and processed map products stays with Jacob Patrick Media.
What you receive is a license. On full payment, you get a perpetual, non exclusive license to use the delivered files to market the property, project or business they were made for. That includes listing sites, the MLS, your website, social media, print collateral, email and paid advertising for that property or business.
The license does not include:
Listings change hands. The license runs to the client who commissioned the shoot. If a listing moves to another agent or brokerage, that party needs their own license, which is usually straightforward and inexpensive. Files may not simply be handed over.
Third parties. Builders, developers, stagers, brokerages and vendors who want to use images they did not pay for can license them directly. Ask me and I will quote it.
Credit. Credit is appreciated but not required, except where a platform's own rules require attribution.
Progress documentation, orthomosaics, measurements and other mapping outputs are visual documentation products. They are not a land survey, and I am not a licensed surveyor or engineer. Measurements taken from aerial imagery are suitable for planning, progress tracking, coordination and estimating. They are not suitable for establishing boundaries, resolving property line disputes, satisfying a permit condition or replacing certified survey data, and they must not be relied on for those purposes. Where a project needs survey grade or certified data, a licensed surveyor is required and I will say so.
Nothing delivered constitutes an engineering, structural, code compliance or insurance opinion. Interpreting what the imagery shows is the client's responsibility and their professionals' call.
Services are provided with professional care and without warranties beyond what the law requires. To the extent the law allows, total liability for any claim arising from a project is limited to the amount you paid for that project. I am not liable for indirect or consequential losses, including lost sales, a listing that did not sell, a delayed closing, lost profits or reputational harm.
If equipment fails or files are lost before delivery, the remedy is a reshoot at no charge where a reshoot is possible, or a refund of amounts paid for the affected work where it is not.
You agree to indemnify me against claims arising from your use of delivered files, from a lack of permission or release for something photographed at your direction, or from your reliance on documentation or mapping outputs beyond the limits described above.
Liability insurance covering drone operations is in place for every flight, and a certificate naming your company is available on request before work starts. Neither party is responsible for failure to perform caused by events outside reasonable control, including severe weather, natural disaster, airspace restriction, illness, or loss of access to the site. Affected work is rescheduled, and amounts paid for work not performed are refunded.
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute is brought in the state or federal courts located in Duval County, Florida, and both parties agree to try to resolve it directly, in good faith, before filing anything.
These terms may be updated, with the current version always posted here and dated. A change does not alter the terms of a project already booked or in progress. If any part of these terms is found unenforceable, the rest stays in force.
